Privacy policy

The Privacy Policy herein contained sets out how the Centre de musique baroque de Versailles uses and protects the information provided by users on its website (URL www.cmbv.fr),  hereinafter referred to as ‘the website’.

Please note that the provisions contained in this Privacy Policy may be modified by the Centre de musique baroque de Versailles at any point, notably to comply with changes in legislation, jurisprudence, regulations or technology. In such an event, the date of modification will feature prominently at the top of the said Privacy Policy. Any such modifications are binding upon the user as soon as they appear online. As such, users must regularly check the Privacy Policy and cookie usage to take cognizance of any such modifications.

I. PERSONAL DETAILS

Generally speaking, users maty visit the www.cmbv.fr website published by the Centre de musique baroque de Versailles without providing any personal details. Whatever the circumstances, users are in no way obliged to disclose such information to the Centre de musique baroque de Versailles.

Nevertheless, the Centre de musique baroque de Versailles may in certain circumstances be required to ask users for their personal details (see Types and purposes of data collection below). 2. Data collection

All user data is supplied by the users themselves.

The Centre de musique baroque de Versailles shall where required obtain user consent and/or offer users the possibility of prohibiting specific usage of their data.

In all cases, users shall be informed of the purpose of the data they provide in the various online data collections forms.

3. Types and purposes of data collection

The Centre de musique baroque de Versailles may process personal user information in order to provide the service(s) requested.  All data is sourced directly from users or from user completed forms.

Creating a PRIVATE E-COMMERCE CUSTOMER ACCOUNT allows users to finalise their purchases and subsequently log in with their memorised email address and personal password, as well as update their personal details, view their purchase history, invoices and addresses.
Creating a PRIVATE E-COMMERCE CUSTOMER ACCOUNT implies consent to the collection and processing of the requested details (i.e. Surname, First Name, Marital Status, Address, Postcode, Town & Phone Number).
This information is collected for the legitimate purpose of creating and managing a user account, allowing the CMBV to dispatch orders and invoices, gather statistical data and, if required, automatically process or profile user data as per CMBV marketing policy to propose further services.

  • [PROFESSIONAL CLIENT ACCOUNT] Procedure for creating a Professional Client Account

Creating a PROFESSIONAL CLIENT ACCOUNT allows users to log in with their email address and personal password for subsequent purchases.
This information is collected for the legitimate purpose of creating and managing a PROFESSIONAL CLIENT ACCOUNT, allowing users to access CMBV private pages (authentication required) and specific content.

  • [NEWSLETTERS] 

Our platform has mailing lists for the following electronic newsletters:

  • A general newsletter containing CMBV news
  • A Cercle Rameau newsletter for Cercle Rameau members and CMBV sponsors detailing our projects and special events
  • A Boutique Newsletter with updates about CMBV online publications, sheet music, CDs and DVDs.

Simply tick the boxes in the forms provided so we can effect the transmission.

Every transmission contains a hypertext link allowing users to unsubscribe whenever they choose.

Our mailing lists are managed by the Mailchimp web portal.

The Centre de musique baroque de Versailles will gather only the relevant data necessary.

4. Personal data

The Centre de musique baroque de Versailles may use the following personal details:

  • Surname, first name, date of birth
  • Phone number, email address, postal address
5. Recipients

Only the Centre de musique baroque de Versailles receives personal user data, whether individual or aggregate, and it is not transmitted to a third party under any circumstances, notwithstanding CMBV subcontractors (see Section 7 below for further details). Neither the Centre de musique baroque de Versailles nor any of its subcontractors market personal details provided by its website users.

6. Data storage

User details will be stored by the Centre de musique baroque de Versailles as long as required, unless users exercise their right to close their account and have their personal details erased, in accordance with the legal obligations governing the storage of records.

A user account which has remained inactive for over 3 years may be closed and the data anonymised.

7. Data gathered outside our platform

The data gathered on our platform shall under no circumstances be transmitted or marketed to third parties, but may on occasions be passed onto third party applications for processing, but only for the following purposes:

  • Online bank payments: When purchasing online by bank card, the data required to process orders (Surname, First Name & Email address) is sent securely to the relevant banking platform PAYBOX SYSTEMS. No bank details are collected or stored on our platform during this process. 
  • Routing of transactional mails: To ensure proper delivery of our transactional mails (confirming creation of account, orders, etc.) via our email routing platform.
  • Mailing lists: To manage (unsubscribe, etc.) mailing lists and route the relevant data.
  • Sales and customer analyses
    • For marketing and management purposes we may be required to conduct automatic data processing (profiling) or semi-automatic data processing (querying) for statistical surveys, sales monitoring and the transmission of product information & special offers.
    • Users may exercise their right to object free of charge at any time by contacting us at the address indicated in the introduction to our Privacy Policy.

8. Data protection

L’Utilisateur dispose des droits suivants concernant ses informations personnelles, qu’il peut exercer en nous écrivant à l’adresse postale mentionnée au point 1.

  • Data access and transmission rights

Users are permitted to access their personal details.

However, due to security and confidentiality regulations governing the Centre de musique baroque de Versailles with regard to the handling of personal data, such requests require proof of identity, notably a valid ID scan (if using our electronic request form) or a signed photocopy of valid ID (if a written request).

The Centre de musique baroque de Versailles advises users that it may if reject blatantly unreasonable requests (i.e. too numerous, repetitive or systematic) if it so sees fit.

  • Right to rectification

Legislation entitles users to request the rectification, updating, locking or deletion of personal data if it proves to be inaccurate, incorrect, incomplete or obsolete.  

Users may also stipulate general and particular instructions regarding what is to be done with their personal data after their death. The heirs of the deceased may ask the Centre de musique baroque de Versailles to proceed with the necessary updates.

  • Right to object

This right only applies under two conditions, namely:

  1. If the right is exercised on legitimate grounds, OR
  2. If the right is exercised to prevent data being used for prospecting purposes.

  • Turnaround time

The Centre de musique baroque de Versailles shall respond to requests from users to access, rectify or object, or any other request for information, and such within a reasonable time not exceeding one month from receipt of the request.

  • Complaints lodged with a competent authority

If you consider that the Centre de musique baroque de Versailles has failed in its obligations with regard to personal data, users may complain to the relevant authority. In France the competent authority is the CNIL, and claims should be sent by email via https://www.cnil.fr/fr/plaintes/internet.

II. COOKIE POLICY

When users first log into the CMBV website, a banner appears at the bottom of the screen warning that browsing details may be stored in cookies.  Our cookie policy explains how we use cookies during browsing, their purpose (Section 1) and setting instructions (Section 2).

1. General information about the cookies on our website

The Centre de musique baroque de Versailles, as publisher of the CMBV website, may insert a cookie in a user’s hard drive (computer, tablet, mobile phone, etc.) to ensure seamless browsing on the website.

The information from cookies does not identify users personally. Cookies help us improve the interactivity and performance of our website and ensure we send you pertinent content. No information is divulged to a third party without prior consent, or unless disclosure of the information is required by law, court order or by an administrative authority.

To explain the information our cookies collect, the list below indicates the sorts of cookies liable to be used on the CMBV website (name, purpose and expiry date).

2. Setting preferences regarding cookies

You can enable or disable cookies at any time.

When users first log onto the CMBV website, a banner appears at the bottom of the screen outlining the process of inserting cookies or other technologies. It states that continuing to browse the CMBV website (e.g. by loading a new page or clicking on a site element) is deemed to mean acceptance of cookies - likewise if users click on the X in the right of the banner at the bottom of the screen.

Depending on the type of cookie, user consent to the insertion on their hard drive and the reading of cookies by the Centre de musique baroque de Versailles may be obligatory.

a. Waiver of consent

In accordance with CNIL recommendations, some cookies do not require prior consent, if essential to the operation of the website or if their sole purpose is to allow or facilitate electronic communication. This is notably the case for session ID, authentication, load balancing and interface customization. Social media sharing cookies are inserted and managed by social network publishers. The Centre de musique baroque de Versailles does not use social network sharing.

c. Cookie setting tools

Most web browsers are configured by default to enable cookies. The browser allows users to modify these standard settings: i.e.  systematically reject all cookies or select which to accept and reject.

CAUTION: we must remind users that disabling cookies on their hard drive may affect user experience and access to certain services in our website. The Centre de musique baroque de Versailles shall not be held liable for reduced browsing performance triggered by a user’s decision to refuse, delete or block cookies that are essential to the function of the website. Such consequences do not constitute damage and give no entitlement to compensation.
